Definition of “Voyager”
For purposes of these Terms & Conditions, “Voyager” means any individual participating in a Space2Sea Voyage, including paying guests, Featured Guests, invited guests, speakers, partners, sponsors, employees, representatives, agents, volunteers, contractors, and any other individual participating in or supporting the Voyage on behalf of FUTURE of SPACE (“FoS”). All Voyagers are subject to and bound by these Terms & Conditions.

1. Assumption of Risk
Voyager acknowledges that participation in a Space2Sea Voyage involves inherent and significant risks, dangers, and hazards that may result in property damage, illness, serious injury, disability, emotional distress, or death.

Such risks include, without limitation:

  • Travel to remote and isolated regions with limited or delayed access to medical care.
  • Expedition cruising and maritime operations.
  • Zodiac embarkation and disembarkation.
  • Helicopter operations and transfers.
  • Wildlife encounters.
  • Hiking, shore landings, and outdoor activities.
  • Extreme weather conditions.
  • Ice, snow, rough seas, and slippery surfaces.
  • Transportation by aircraft, vessel, vehicle, or other conveyance.
  • Delays, diversions, missed connections, cancellations, and itinerary changes.
  • Acts of third-party suppliers.
  • Political, governmental, environmental, or public health events.

Voyager knowingly and voluntarily assumes all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in the Voyage.

2. Medical Fitness and Health Responsibility
Voyager represents and warrants that he or she is physically and mentally capable of participating in the Voyage.

Voyager is solely responsible for evaluating personal fitness for participation and for obtaining any required vaccinations, medications, medical clearances, or travel documentation.

Voyager acknowledges that medical facilities, personnel, medications, emergency services, and evacuation resources available during the Voyage may be limited, delayed, unavailable, or materially different from those available in Voyager’s home country.

Voyager authorizes emergency medical treatment when deemed necessary by medical personnel, expedition leaders, vessel personnel, or emergency responders.

All costs associated with medical treatment, evacuation, hospitalization, transportation, repatriation, or related services shall be the sole responsibility of the Voyager.

Women who have entered their twenty-fourth (24th) week of pregnancy (23 weeks and 1 day) at the time of embarkation are not permitted to participate in the Voyage.

Voyager is solely responsible for determining eligibility to travel, including compliance with this pregnancy restriction, and for consulting with their physician regarding fitness to participate. FUTURE of SPACE assumes no responsibility to determine, verify, monitor, or evaluate a Voyager’s pregnancy status or medical fitness.

3. Release and Waiver of Liability
To the fullest extent permitted by law, Voyager releases, waives, discharges, and covenants not to sue FUTURE of SPACE, its affiliates, partners, sponsors, employees, officers, directors, contractors, representatives, agents, successors, assigns, and all third-party suppliers, including vessel operators, airlines, charter operators, transportation providers, guides, hotels, and service providers, collectively, the “Released Parties,” from any and all claims, liabilities, damages, losses, expenses, costs, or causes of action arising out of or related to participation in the Voyage.

This release includes claims arising from:

  • Personal injury, illness, disability, or death.
  • Property damage, theft, or loss.
  • Medical emergencies.
  • Delays, cancellations, diversions, or schedule changes.
  • Acts or omissions of third-party providers.
  • Ordinary negligence of any Released Party.

Nothing herein shall waive rights that cannot legally be waived under applicable law.

4. Travel Insurance Required

As a condition of participation, Scenic requires all Voyagers to maintain comprehensive travel insurance that includes, at a minimum, emergency medical and emergency medical evacuation coverage.

Voyagers are solely responsible for obtaining and maintaining travel insurance that satisfies Scenic’s insurance requirements prior to departure.

To assist our Voyagers, FUTURE of SPACE provides convenient access to Allianz travel insurance through the QuoteMax platform. Voyagers are free to purchase coverage through Allianz or any insurance provider of their choice, provided the policy satisfies Scenic’s insurance requirements.

INTERNATIONAL RESIDENTS

Please obtain comparable travel insurance through an insurance provider in your country of residence.

You are free to purchase travel insurance through Allianz or any insurance provider of your choice, provided your policy satisfies Scenic’s travel insurance requirements.

We encourage purchasing travel insurance shortly after making your initial voyage deposit, as eligibility for certain policy benefits, including coverage for pre-existing medical conditions, may depend on when coverage is purchased. Please review your policy for complete terms, conditions, and exclusions.

FUTURE of SPACE facilitates access to travel insurance for your convenience but does not sell insurance, recommend policies or providers, interpret coverage, or provide insurance advice.

5. Program, Featured Guests, Flights, and Itinerary Changes

The Voyage is an expedition experience operating in dynamic and remote environments. As a result, flexibility is essential, and changes may be necessary to protect the safety of Voyagers, crew, wildlife and the environment.

FUTURE of SPACE reserves the right, when reasonably necessary, to alter, substitute, postpone, cancel, modify, or remove any aspect of the Voyage, with or without prior notice, including:

  • Itineraries
  • Ports of call
  • Activities
  • Excursions
  • Transportation
  • Charter flights
  • Hotels
  • Ground transfers
  • Featured Guests
  • Programming
  • Expedition staff

No representation or guarantee is made regarding the participation of any Featured Guest, speaker, entertainer or other individual.

Featured Guests, expedition leaders, crew members, and other participants are subject to change without notice. FUTURE of SPACE does not guarantee participation, appearance, presentation, performance, accessibility, availability, or interaction with any specific individual.  Such changes shall not constitute grounds for cancellation, refund, compensation, credit, or legal claim.

Voyager acknowledges that failure to arrive for embarkation, including due to missed flights or travel delays, is solely the responsibility of the Voyager.

The Captain, expedition leader, vessel operator, and local authorities retain final authority over matters affecting the safe operation of the Voyage. They may alter the itinerary, activities, embarkation or disembarkation procedures, or other operational aspects of the Voyage at any time for reasons including safety, navigation, weather, sea ice conditions, environmental or wildlife protection, operational requirements, or legal compliance. Such decisions are final.

6. Payments, Cancellations, and Refund Policy
Deposits, payments, fees, cancellations, refunds, credits, and related matters shall be governed by the applicable Reservation Policy and Payment & Cancellation Policy for the specific Voyage, which are incorporated herein by reference.

All deposits, payments, fees, and charges shall remain subject to the terms of those policies.

Failure to make timely payments may result in cancellation of reservation and forfeiture of amounts previously paid, as provided in the applicable policies.

Unused services, missed activities, voluntary withdrawal, late arrival, early departure, or removal from the Voyage do not entitle Voyager to any refund or credit except as expressly stated in the applicable policies.

7. Conduct and Removal
Voyager agrees to comply with all laws, regulations, vessel policies, safety procedures, and instructions issued by FUTURE of SPACE, expedition staff, vessel personnel, transportation providers, and local authorities. 

Voyager acknowledges that FUTURE of SPACE, the vessel operator, expedition leader, or Captain may deny embarkation, require disembarkation, or refuse participation in any activity if a Voyager’s conduct, health, or condition is reasonably believed to present a risk to the safety, security, well-being, or enjoyment of the Voyage for themselves or others.

FUTURE of SPACE may remove, deny participation to, or disembark any Voyager whose conduct is deemed unsafe, disruptive, inappropriate, unlawful, abusive, threatening, or detrimental to the Voyage experience.

Removal may occur without prior warning and without refund, reimbursement, compensation, or liability.

Prohibited conduct includes, without limitation:

  • Harassment or discrimination.
  • Physical altercations.
  • Illegal drug use.
  • Excessive intoxication.
  • Unauthorized drone operations.
  • Violations of environmental regulations.
  • Conduct endangering wildlife or other participants.

Voyager shall be solely responsible for any fines, penalties, damages, costs, or liabilities arising from such conduct.

8. Captain’s Authority

Voyager acknowledges that the Captain, vessel operator, expedition leader, and local authorities retain absolute authority over the safe operation of the vessel and expedition activities. Decisions regarding navigation, weather, sea ice, wildlife, health, safety, security, embarkation, disembarkation, and itinerary modifications are final and binding. Voyager agrees to comply with all lawful instructions issued by the Captain, expedition staff, vessel personnel, and local authorities.

9.  Force Majeure

A Force Majeure Event means an event beyond the reasonable control of FUTURE of SPACE, including but not limited to acts of God, natural disasters, severe weather, sea ice conditions, war, terrorism, governmental actions, sanctions, port closures, travel restrictions, epidemics, pandemics, civil unrest, or other similar external events.

For the avoidance of doubt, a Force Majeure Event does not include mechanical breakdown, engine failure, equipment malfunction, maintenance failure, financial distress, regulatory non-compliance, or circumstances arising from the failure of FUTURE of SPACE or its expedition partners to properly maintain or operate the vessel, unless directly caused by an external Force Majeure Event.

If a Force Majeure Event materially affects the Voyage or makes the Voyage impossible, FUTURE of SPACE may modify, postpone, shorten, substitute, or cancel any portion of the Voyage. FUTURE of SPACE shall not be liable for delays, interruptions, modifications, substitutions, or cancellations resulting from a Force Majeure Event.

Any available credits, refunds, or other remedies shall be determined in accordance with the applicable Reservation Policy and Payment & Cancellation Policy.

10. Third-Party Suppliers
FUTURE of SPACE acts solely as a coordinator of travel experiences and utilizes independent third-party suppliers, including vessel owners and operators, charter operators, airlines, transportation providers, hotels, guides, expedition operators, ground handlers, and other service providers.  Voyager acknowledges that FUTURE of SPACE does not own, operate, manage, or control the vessel, aircraft, hotels, transportation providers, or other independent suppliers providing services during the Voyage.

FUTURE of SPACE is not responsible for the acts, omissions, negligence, insolvency, bankruptcy, delays, defaults, failures, schedule changes, cancellations, or conduct of any third-party supplier.

Any claims arising from services provided by a third-party supplier shall be directed solely to the applicable supplier.

The liability of any vessel owner, vessel operator, airline, charter operator, hotel, transportation provider, or other supplier shall be governed by such supplier’s applicable terms and conditions, ticket contracts, tariffs, passage contracts, or other governing documents.

11. Photography, Audio, Video and Media Release
Voyager grants FUTURE of SPACE and its partners a perpetual, irrevocable, worldwide, royalty-free license to photograph, record, reproduce, distribute, publish, display, edit, and otherwise use Voyager’s name, voice, image, likeness, appearance, and statements in any media now known or later developed.

Such use may be for promotional, educational, editorial, archival, documentary, commercial, or marketing purposes without compensation or further approval.

Voyagers wishing to avoid individual feature photography must notify FUTURE of SPACE in writing prior to embarkation.

Voyager waives any right to inspect, approve, or review any finished materials or the use to which such materials may be applied.

12. Minors
Unless otherwise stated for a specific Voyage, participants must be at least six (6) years of age at the time of embarkation. Any Voyager under eighteen (18) years of age must be registered by a parent or legal guardian. The parent or guardian accepts full responsibility for the minor and agrees to these Terms on behalf of the minor.

13. Travel Documents and Entry Requirements
Voyager is solely responsible for obtaining and maintaining all passports, visas, permits, vaccinations, medical documentation, customs, immigration, biosecurity, and other travel requirements necessary for participation in the Voyage.

Unless a longer validity period is required by applicable law or destination requirements, Voyager’s passport must be valid for at least six (6) months beyond the conclusion of the Voyage.

Failure to obtain or maintain required documentation, or failure to satisfy applicable entry requirements, shall not constitute grounds for refund, credit, compensation, or cancellation by FUTURE of SPACE.

14. Reservation Transfer Restrictions
Voyage reservations may not be sold, transferred, assigned, exchanged, or otherwise conveyed without the prior written consent of FUTURE of SPACE.

15. Conclusion of Services
Unless otherwise expressly stated in writing, FUTURE of SPACE’s responsibilities conclude upon completion of the official Voyage program, including any included group transfers specifically identified in the published itinerary.

FUTURE of SPACE is not responsible for transportation, lodging, meals, activities, or other services outside the published Voyage program.

16. Limitation of Liability
To the maximum extent permitted by law, the aggregate liability of FUTURE of SPACE arising from or relating to the Voyage shall not exceed the total amount actually paid, if any, directly to FUTURE of SPACE by the Voyager for participation in the Voyage.

Under no circumstances shall FUTURE of SPACE be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of enjoyment, loss of opportunity, emotional distress, loss of profits, or other intangible losses.

17. Arbitration; Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to the Voyage, these Terms & Conditions, the Reservation Policy, the Payment & Cancellation Policy, or any participation in a FUTURE of SPACE experience shall be resolved exclusively through final and binding arbitration administered in Clark County, Nevada, in accordance with the rules of the American Arbitration Association then in effect.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms & Conditions.

Each party shall bear its own attorneys’ fees, expert fees, and costs unless otherwise awarded by the arbitrator under applicable law.

Voyager expressly waives any right to participate in a class action, collective action, representative proceeding, private attorney general action, or jury trial.

Arbitration shall be conducted on an individual basis only. The arbitrator may not consolidate claims of multiple parties or preside over any form of representative or class proceeding.

Any arbitration award may be entered and enforced in any court of competent jurisdiction.

18. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.

19. Severability
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement
These Terms & Conditions, together with the applicable Reservation Policy, Payment & Cancellation Policy, Privacy Policy, and any Voyage-specific materials expressly incorporated by reference, constitute the entire agreement between Voyager and FUTURE of SPACE concerning participation in the Voyage. 

No oral statement, marketing material, website content, social media content, or prior communication shall modify these Terms & Conditions unless expressly agreed to in a written agreement signed by an authorized representative of FUTURE of SPACE.

Acknowledgement
By registering for, paying for, or participating in a FUTURE of SPACE experience and/or Space2Sea Voyage, Voyager acknowledges that he or she has carefully read, fully understands, and voluntarily agrees to these Terms, Conditions, Assumption of Risk, Waiver, and Release of Liability, and intends to be legally bound by them.
